If you’re unhappy with your injury attorney, can you hire someone else?

Yes.

You have free will to choose who represents you in your injury claim. However, before terminating your current attorney, you want to review your Retainer Agreement to see what obligations, if any, you may have as a result of terminating your attorney.

For example, most Retainer Agreements are Contingency Agreements, which mean that there is no fee due to the attorney if there is no recovery to the client. However, the contract may dictate that you will be responsible for costs associated with your claim despite recovery. Even more, some attorneys bill hourly for the time that they have worked on your case.

So, prior to ending any attorney-client relationship, it’s best to know if and/or how terminating the relationship may affect your case.
